According to Article 3 of the Polish Personal Income Tax Act, an individual is considered a tax resident in Poland if they meet any of the following criteria:

  • They have their permanent place of residence in Poland.
  • They stay in Poland for more than 183 days in a calendar year.
  • They have their center of vital interests (family, economic, social) in Poland.

For entities, the Corporate Income Tax Act defines tax residency based on the following criteria:

  • The entity is incorporated in Poland.
  • The entity's management and control are located in Poland.
