## What Is a Tax Information Exchange Agreement (TIEA)?

A Tax Information Exchange Agreement (TIEA) is a bilateral international tax agreement under which jurisdictions cooperate by exchanging information relevant to enforcing domestic tax laws.

*Also known as: TIEA, Information Exchange Agreement.*

## How Tax Information Exchange Agreement (TIEA) works

A Tax Information Exchange Agreement (TIEA) is a bilateral treaty under which two territories agree to share information relevant to a covered tax matter, allowing each government to enforce domestic tax law where a taxpayer, account or company sits partly outside its own borders. TIEAs are typically concluded where no comprehensive double tax treaty exists, and the UK government lists many such agreements, including one with the Bahamas. Exchange under a TIEA generally takes place on request concerning specific taxpayers, and the agreement neither allocates taxing rights nor relieves double taxation. Automatic exchange under the Common Reporting Standard now operates alongside TIEAs, and the scope of each agreement depends on its text and the taxes covered.

## Tax Information Exchange Agreement (TIEA) vs Double Tax Treaty (DTT)

Unlike a double tax treaty, which allocates taxing rights and provides relief from double taxation, a Tax Information Exchange Agreement (TIEA) deals only with cooperation and information sharing between tax authorities.

## Example

Illustrative example: The tax authority of Country A audits a resident consultant who reports no foreign income. Country A sends a request under its TIEA with Country B for records of a company and bank account linked to the consultant, and Country B's authority gathers and returns the information, which Country A then uses in the audit.

## Common misconception

**Myth:** A jurisdiction without a double tax treaty shares tax information with nobody in the home country.

**Reality:** Jurisdictions without a double tax treaty may still exchange information through a Tax Information Exchange Agreement, multilateral conventions or automatic exchange under the Common Reporting Standard.

## Frequently asked questions

### What is the purpose of a TIEA?

A Tax Information Exchange Agreement allows governments to enforce domestic tax laws by exchanging information relevant to a tax matter covered by the agreement, according to UK government guidance.

### Is a TIEA the same as a tax treaty?

A Tax Information Exchange Agreement is a treaty limited to information exchange, whereas a double tax treaty also allocates taxing rights, limits withholding and provides relief from double taxation.
