## What Is Tax Evasion?

Tax evasion is a criminal offence under national law under which a person deliberately conceals income or facts to escape a legally owed tax.

## How Tax Evasion works

Tax evasion is the deliberate, unlawful non-payment or under-reporting of tax, typically by hiding income, inflating deductions or concealing foreign accounts, and the offence applies when a taxpayer knowingly breaches a reporting or payment obligation which national law clearly imposes on that taxpayer. Intent is the decisive element: in the United States, 26 U.S.C. 7201 targets wilful attempts to evade tax, with fines and up to five years' imprisonment. Negligent or mistaken errors generally lead to civil penalties instead, and disclosure procedures differ by country. Automatic exchange of information under CRS and FATCA has increased detection of undeclared offshore income, while definitions and sanctions vary by jurisdiction.

## Tax Evasion vs Artificial Avoidance

Unlike artificial avoidance, which uses lawful but abusive arrangements that anti-abuse rules may counteract, tax evasion involves deliberately concealing facts or breaching obligations and can lead to criminal prosecution.

Illustrative example: A freelancer resident in Country A receives client payments into an account in Country B and leaves the income off Country A returns while knowing the income is taxable. Country A receives the account data through automatic exchange, and the deliberate omission may be pursued as evasion rather than an innocent error.

## Common misconception

**Myth:** Income kept in a foreign bank account stays invisible to the home tax authority.

**Reality:** Automatic exchange of financial account information generally reports foreign accounts to the holder's residence country, so deliberate omission exposes the holder to evasion proceedings.
