What Is Permanent Residence?

Permanent residence is an immigration status granting a foreign national an indefinite right to live in a country, distinct from tax residency under national law.

Also known as: PR, Permanent Resident Status.

How Permanent Residence works

Permanent residence is obtained after lawful residence for a qualifying period or through family, employment or investment routes, and the resulting status allows indefinite stay, while tax consequences follow from separate residency rules which may or may not treat the permit holder as a tax resident. Within the EU, long-term resident status under Directive 2003/109/EC generally requires five years of legal and continuous residence, with a permit valid for at least five years and automatically renewable. The United States links both concepts: a lawful permanent resident is a US resident for federal tax purposes under the green card test until the status is abandoned in writing or terminated.

Permanent Residence vs Tax Residency

Unlike tax residency, which depends on presence, home or centre of interests under tax law, permanent residence is an immigration right to remain and does not by itself settle where income is taxed.

Example

Illustrative example: A consultant holds permanent residence in Country A but spends most of the year in Country B. Country A may treat the consultant as non-resident for tax because of limited presence, while Country B applies its own day-count and home tests; a US green card, by contrast, keeps US tax residence until formally ended.

Common misconception

Myth: Holding permanent residence automatically makes a person tax resident in that country.

Reality: Permanent residence generally governs the right to live in a country, while tax residency is tested separately, except where law links both, as under the US green card test.

Frequently asked questions

Does permanent residence make someone a tax resident?

Permanent residence does not by itself create tax residency in most countries; tax law applies separate tests, although the United States treats lawful permanent residents as residents for federal tax purposes under the green card test.

How long does it take to get EU long-term residence?

EU long-term resident status under Directive 2003/109/EC generally requires five years of legal and continuous residence in the Member State immediately before the application, with national conditions and exceptions applying.
