## What Is an Offshore Account?

An Offshore Account is a bank or investment account held outside the holder's country of tax residence, generally lawful but subject to reporting rules.

*Also known as: Offshore Bank Account, Foreign Bank Account.*

## How Offshore Account works

An Offshore Account is any deposit, custody or investment account opened with a financial institution outside the holder's country of tax residence, and holding one is generally lawful, while income and balances usually remain taxable and reportable in the residence country under its rules. US persons, for example, file FinCEN Form 114 (FBAR) when foreign accounts exceed $10,000 in aggregate at any time during the year. Many banks also report account data to the holder's residence country under automatic exchange of information. Penalties for non-disclosure vary by country and can be substantial.

## Offshore Account vs Offshore Finance Centre

Unlike an Offshore Finance Centre, which describes a jurisdiction whose financial sector mainly serves non-residents, an Offshore Account describes the holder's relationship to a single account abroad, wherever located.

## Example

Illustrative example: A designer resident in Country A keeps a savings account from earlier years in Country B. Country A taxes the interest as foreign income, and Country B's bank may send account details to Country A under automatic exchange, so omissions on the return can be detected.

## Common misconception

**Myth:** Money in an offshore account is outside the reach of the home tax authority.

**Reality:** Offshore Account balances and income are generally visible to residence-country authorities through automatic exchange of information and remain subject to declaration under local law.

## Frequently asked questions

### Is having an offshore bank account legal?

An Offshore Account is generally lawful to open and hold; legal risk usually arises from failing to declare the account or its income, or from breaching exchange-control or sanctions rules, subject to local law.

### Do offshore accounts have to be reported to tax authorities?

Offshore Account reporting depends on residence-country law; US persons, according to the IRS, file an FBAR when aggregate foreign accounts exceed $10,000 at any time during the calendar year.
