## What Is Non-Resident Withholding Tax?

Non-Resident Withholding Tax is a source-country collection mechanism under which a payer deducts income tax from dividends, interest, royalties or similar payments made to non-residents.

*Also known as: NRA Withholding, Non-Resident Tax Withheld at Source.*

## How Non-Resident Withholding Tax works

Non-Resident Withholding Tax is tax deducted at source by a payer, such as a bank, company or tenant acting as withholding agent, when income arising in one country is paid to a recipient resident elsewhere, so the source country collects tax without the recipient registering. Domestic law sets the statutory rate, which varies by country and income type. The United States, for example, applies a 30% default to most US-source income of foreign persons, reducible by statute or treaty. Reduced treaty rates generally require residence documentation before payment, and the residence country may then grant a foreign tax credit, subject to local rules.

## Non-Resident Withholding Tax vs Withholding Tax

Unlike withholding tax in general, which also covers wage deductions for resident employees, Non-Resident Withholding Tax targets payments crossing a border and is often the main way a source country taxes passive income of foreign recipients.

## Example

Illustrative example: A freelancer resident in Country B holds shares in a company in Country A. When dividends are paid, the company withholds Country A's statutory rate unless a residence certificate supports the lower treaty rate, and Country B then generally credits the tax withheld against its own tax on the dividend.

## Common misconception

**Myth:** Tax withheld abroad settles all tax due on the income.

**Reality:** Non-Resident Withholding Tax usually settles only the source country's claim, while the residence country generally still taxes the income and grants relief under its own rules or a treaty.

## Frequently asked questions

### Can non-resident withholding tax be reduced by a treaty?

Non-Resident Withholding Tax can generally be reduced or eliminated where a double tax treaty applies, provided the recipient documents treaty residence and beneficial ownership before payment or claims a refund afterwards.

### Is non-resident withholding tax a final tax?

Non-Resident Withholding Tax is final in some countries for passive income, while other countries require a non-resident tax return, particularly for business or property income; treatment depends on domestic law.
