## What Is a Non-Resident Tax Return?

A Non-Resident Tax Return is a compliance filing in which a non-resident reports income sourced in a country, with filing triggers set by national law.

*Also known as: Non-Resident Income Tax Return, Form 1040-NR.*

## How Non-Resident Tax Return works

A Non-Resident Tax Return is the declaration a source country requires from a non-resident who earns income there, typically from rental property, local business activity or income not fully taxed by withholding, and it reports only the country's limited tax base rather than worldwide income. In the United States, nonresident alien individuals, estates and trusts use Form 1040-NR, for instance when engaged in a US trade or business. HMRC usually expects Self Assessment from non-residents who rent out UK property, work for themselves in the UK or have other untaxed UK income. Triggers, deadlines and allowances vary by country and are subject to local rules.

## Non-Resident Tax Return vs Resident Tax Return

Unlike a resident tax return, which generally reports worldwide income, a Non-Resident Tax Return covers only income sourced in the filing country, often with fewer allowances and with treaty relief claimed separately.

## Example

Illustrative example: A consultant leaves Country A and becomes resident in Country B but keeps a rented apartment in Country A. Country A may require a Non-Resident Tax Return reporting the rent, while Country B taxes the same rent as part of worldwide income and generally grants relief for Country A's tax.

## Common misconception

**Myth:** Leaving a country ends every tax filing obligation there.

**Reality:** Ceasing tax residence generally ends worldwide reporting, but income still sourced in the former country, such as rent or local business profits, can require a Non-Resident Tax Return.

## Frequently asked questions

### Which form do non-resident aliens file in the US?

Nonresident alien individuals, estates and trusts generally file Form 1040-NR, according to the IRS, for example when engaged in a trade or business in the United States.

### Do non-residents of the UK file Self Assessment?

Non-residents usually file UK Self Assessment, according to GOV.UK, when renting out UK property, working for themselves in the UK, or receiving other untaxed UK income; treaty relief claims can change reporting.
