What Is the Non-Resident Landlord Scheme?

The Non-Resident Landlord Scheme is a UK collection mechanism under which letting agents or tenants deduct income tax from rent paid to landlords living abroad.

Also known as: NRL Scheme, NRLS.

How Non-Resident Landlord Scheme works

The Non-Resident Landlord Scheme (NRLS) applies when a landlord's usual place of abode is outside the United Kingdom, a test distinct from UK tax residence, and requires the landlord's representative, usually the letting agent or otherwise the tenant, to deduct basic rate income tax from rent and pay the amount to HMRC. HMRC guidance treats landlords abroad, or expected to be abroad, for more than six months as within scope. Tenants paying less than £100 a week directly need not deduct unless HMRC says otherwise, although the limit does not apply to agents. A landlord may apply for approval to receive rent without deduction, and the rental profit then remains taxable through Self Assessment.

Non-Resident Landlord Scheme vs Non-Resident Withholding Tax

Unlike a final Non-Resident Withholding Tax, the Non-Resident Landlord Scheme deduction operates as a payment on account, with the landlord's actual UK liability on rental profit settled through Self Assessment.

Example

Illustrative example: A UK citizen moves to Country A for several years and lets a flat in Manchester through an agent. Without HMRC approval, the agent deducts basic rate tax from the rent; with approval, rent is paid gross and the landlord reports the rental profit on a UK Self Assessment return.

Common misconception

Myth: Approval to receive rent gross means the rent is exempt from UK tax.

Reality: HMRC approval under the Non-Resident Landlord Scheme only removes deduction at source, and the rental profit remains taxable through Self Assessment.

Frequently asked questions

Who has to operate the non-resident landlord scheme?

Under the Non-Resident Landlord Scheme, the letting agent deducts tax from rent paid to a landlord living abroad; where no agent acts, the tenant does so, unless the tenant pays less than £100 a week directly.

Does the non-resident landlord scheme depend on tax residence?

The Non-Resident Landlord Scheme looks at whether the landlord's usual place of abode is outside the United Kingdom, a test distinct from UK tax residence under the statutory residence test.
