## What Is International Tax?

International Tax refers to the body of domestic rules and treaty provisions under which states tax income, gains and assets crossing national borders.

*Also known as: International Taxation, Cross-Border Taxation.*

## How International Tax works

International Tax is the field which determines how income, gains and assets connected to more than one country are taxed, combining each state's domestic rules on residence and source with bilateral tax treaties, anti-abuse measures and information-exchange agreements between tax administrations. Residence-based rules generally reach worldwide income, and the United States, for example, taxes its citizens and resident aliens on foreign income regardless of where they live. Nonresident aliens in the United States are taxed on income effectively connected with a US trade or business at graduated rates and on certain US-source passive income at a flat 30 percent or a lower treaty rate. Where residence and source claims overlap, treaties and foreign tax credits allocate taxing rights and relieve double taxation, subject to each country's law.

## International Tax vs Cross-Border Tax Planning

Unlike Cross-Border Tax Planning, which describes arranging affairs within the rules, International Tax refers to the rules themselves: the domestic and treaty provisions which allocate taxing rights between states.

## Example

Illustrative example: A freelance designer resident in Country A invoices clients in Country B. Country A taxes the designer's worldwide income on residence grounds, Country B may withhold tax at source on the fees, and the treaty between the two countries decides which state keeps taxing rights and how Country A credits the foreign tax.

## Common misconception

**Myth:** Income earned from foreign clients falls outside every country's tax net.

**Reality:** In most cases the country of tax residence taxes worldwide income and the source country may also tax certain payments, so foreign-client income generally remains taxable somewhere.

## Frequently asked questions

### What does international tax cover?

International Tax covers residence and source rules, double tax treaties, foreign tax credits, withholding taxes, transfer pricing, controlled foreign company rules and automatic exchange of information between tax administrations.

### Do I pay tax in two countries?

International Tax rules can expose the same income to tax in two countries when residence and source claims overlap; treaties, foreign tax credits or exemptions generally relieve the resulting double taxation, subject to each country's conditions.
