## What Is Form W-8?

The IRS foreign status certificate series refers to United States withholding forms under which foreign persons document non-US status and claim treaty-reduced withholding.

*Also known as: W-8 Series, IRS W-8 Forms.*

## How Form W-8 works

Form W-8 is requested by a withholding agent, such as a US platform, broker or client, before paying US-source income to a payee who claims foreign status, and the correct variant depends on who the payee is and what income is received. Foreign individuals generally use W-8BEN, foreign entities W-8BEN-E, recipients of effectively connected income W-8ECI, foreign governments and certain organisations W-8EXP, and intermediaries W-8IMY. The form stays with the payer rather than the IRS and is generally valid until the end of the third calendar year after signature, unless circumstances change. Without a valid certificate, payers may apply default withholding, which reaches thirty percent on certain US-source income.

## Form W-8 vs Form W-9

Unlike Form W-9, which US persons use to provide a taxpayer identification number to payers, Form W-8 certifies that the payee is not a US person.

## Example

Illustrative example: A freelance designer resident in Country A invoices a US company, while the designer's Country A agency also receives US royalties. The US company requests Form W-8BEN from the designer as an individual, and the royalty payer requests Form W-8BEN-E from the agency as a foreign entity.

## Common misconception

**Myth:** Any W-8 version works as long as the payee is outside the US.

**Reality:** Form W-8 variants are not interchangeable, because the correct certificate depends on whether the payee is an individual, an entity, an intermediary or receives effectively connected income.
