## What Is Exchange of Information in Tax?

Exchange of Information refers to administrative cooperation under which tax authorities of separate jurisdictions share taxpayer data foreseeably relevant to enforcing domestic tax laws.

*Also known as: EOI, Tax Information Exchange.*

## How Exchange of Information works

Exchange of Information operates through a legal basis such as a tax treaty article, a tax information exchange agreement or an EU directive, and the deciding test is whether the requested data is foreseeably relevant to administering or enforcing the requesting country's domestic tax law. Council Directive 2011/16/EU distinguishes three forms: exchange on request, automatic exchange of predefined information, and spontaneous exchange at any moment without prior request. Under the same Directive, a requested Member State gathers information even without a domestic tax interest and cannot refuse solely because a bank holds the information. Scope, safeguards and procedures vary between treaties and jurisdictions.

## Exchange of Information vs Automatic Exchange of Information (AEOI)

Unlike Automatic Exchange of Information, which is one form covering predefined data sent periodically, Exchange of Information is the umbrella concept that also includes requests about specific taxpayers and spontaneous transmissions.

## Example

Illustrative example: A freelancer declares residence in Country B, while Country A, the former home country, suspects continued residence. Country A's tax authority asks Country B, under their treaty, for records of the freelancer's local registration and income, while financial account data may already arrive automatically each year.

## Common misconception

**Myth:** Moving residence ends the former country's visibility over foreign accounts and income.

**Reality:** Treaty and directive-based exchange allows the former country's tax authority to obtain foreseeably relevant information from the new country, including information held by banks.
