What Is a Dual Status Alien?

Dual Status Alien is a United States tax classification for a non-citizen who is a resident and a nonresident alien within one tax year.

Also known as: Dual-Status Taxpayer, Dual-Status Individual.

How Dual Status Alien works

Dual Status Alien treatment applies in a year when a non-citizen becomes or stops being a United States resident, typically the year of arrival or departure, and the year is split so that income from all sources is taxed during the resident period and only United States-source income during the nonresident period. An individual resident at year-end files Form 1040 marked as a dual-status return with a statement for the nonresident period, and an individual nonresident at year-end files Form 1040-NR with a statement for the resident period. Restrictions include no standard deduction and no joint return, except where a dual-status individual married to a United States citizen or resident elects joint filing.

Dual Status Alien vs Dual Resident

Unlike a Dual Resident, who is resident in two countries at the same time, a Dual Status Alien holds two United States statuses in sequence within one tax year.

Example

Illustrative example: A non-citizen developer earns salary in Country A early in a year, then moves for a United States job and becomes resident from the residency starting date. The earlier Country A salary is foreign-source income of the nonresident period and generally outside United States tax, while worldwide income after the starting date is taxable on a dual-status Form 1040.

Common misconception

Myth: A mid-year move to or from the United States allows filing as a full-year resident with the standard deduction.

Reality: A Dual Status Alien generally files one return covering both periods, cannot claim the standard deduction, and can file jointly only through an election with a United States citizen or resident spouse.
