## What Is Dividend Withholding Tax?

Dividend Withholding Tax is a source-country tax deducted from dividends paid to shareholders, with rates set by national law and often reduced by treaties.

*Also known as: Withholding Tax on Dividends, Dividend Tax at Source.*

## How Dividend Withholding Tax works

Dividend Withholding Tax applies when a company resident in one country distributes profits to a shareholder, and the paying company or its agent deducts the tax from the gross dividend and remits it to the source-country tax authority, so the shareholder receives a net amount before any residence-country taxation. Under United States rules, for example, United States-source dividends not effectively connected with a United States business bear tax at 30 percent of the gross amount, or a lower treaty rate. Treaties generally cap the source rate, such as 15 percent in most cases under the 2016 United States Model, and the European Union Parent-Subsidiary Directive exempts qualifying distributions to parent companies in other Member States.

## Dividend Withholding Tax vs Treaty Withholding Rate

Unlike a Treaty Withholding Rate, which is only a ceiling agreed between two states, Dividend Withholding Tax is the tax actually levied under domestic law, at the treaty rate only where documentation or a refund claim secures treaty relief.

## Example

Illustrative example: A freelance developer resident in Country A holds shares in a Country B company. Country B withholds tax on each dividend at its domestic rate unless treaty residence is documented in advance; otherwise the excess over the treaty cap may be reclaimed later. Country A then generally taxes the dividend and credits the Country B tax up to the treaty rate.

## Common misconception

**Myth:** Tax withheld abroad on dividends is final, so no declaration is needed at home.

**Reality:** In most cases the residence country still taxes the dividend and relieves foreign Dividend Withholding Tax through a credit, often limited to the treaty rate, subject to local rules.
