## What Is a Digital Permanent Establishment?

A Digital Permanent Establishment is a proposed tax nexus concept under which user-based digital activity, without physical premises, creates taxable business presence in a jurisdiction.

*Also known as: Virtual Permanent Establishment, Significant Digital Presence.*

## How Digital Permanent Establishment works

A Digital Permanent Establishment is a nexus concept under which a non-resident business becomes taxable on profits in a country because of digital revenues, users or online contracts there, instead of offices, staff or dependent agents, which traditional treaty-based permanent establishment rules generally require. The European Commission's 2018 significant digital presence proposal would have deemed a permanent establishment to exist where revenues from users in a Member State exceeded EUR 7 000 000, users exceeded 100 000, or business contracts exceeded 3 000\. Most tax treaties still generally require a fixed place of business or a dependent agent, so a digital presence alone rarely meets treaty definitions. Some countries apply domestic significant economic presence rules, and treaty protection decides whether those rules bite.

## Digital Permanent Establishment vs Digital Services Tax (DST)

Unlike a Digital Services Tax, which is a separate levy on gross digital revenues, a Digital Permanent Establishment would extend corporate income tax on profits to digital presence.

## Example

Illustrative example: A company resident in Country A sells online subscriptions to many users in Country B without staff or servers there. Under a traditional treaty definition, no permanent establishment usually arises in Country B; under a significant digital presence rule like the EU proposal, user and revenue thresholds could create taxable presence and profit attribution.

## Common misconception

**Myth:** Any foreign website or online sales to a country automatically create a permanent establishment there.

**Reality:** Under most current treaties, a Digital Permanent Establishment is not recognised, and taxable presence generally still requires a fixed place of business or a dependent agent, subject to domestic rules.

## Frequently asked questions

### What is a digital permanent establishment?

A Digital Permanent Establishment is a proposed nexus concept under which a business is taxable in a country based on digital revenues, users or online contracts there rather than physical premises.

### Does a website create a permanent establishment?

A website alone generally does not create a permanent establishment under most current tax treaties, although proposals for a Digital Permanent Establishment and some domestic significant economic presence rules take a broader approach.
